The prison pastor for Kenneth Eugene Smith, set to become the first US inmate to be put to death with nitrogen gas, said the death row resident is 'really struggling' in his final hours. Smith, 58, is awaiting a Hail Mary decision by the US Supreme Court to stay his execution on Thursday night, the day after SCOTUS previously rejected his appeal to halt the sentence. He was sentenced to death in 1996 for the murder-for-hire slaying of a preacher's wife in 1988.
