A Miami Beach landlord has threatened to evict everyone living in its 102-unit building and said they have failed to maintain it. More than 140 residents at the three-story waterfront property at 6484 Indian Creek Drive were served an eviction lawsuit which ordered them to respond within five days or possibly be removed from their homes. Our main concern is, and always has been, the safety of the residents and the proper maintenance of the building. We are not residential real estate developers and have no interest in selling the property or evicting anyone. Direct discussions with the Association’s new president have left us confident that she shares our concern about the condition and safety of the balconies and is in the process of hiring an engineering firm to assess and address the necessary repairs to ensure the structural safety and integrity of the balconies and overall building. As part of those discussions, we have requested the Association notify the residents not to use the balconies until their safe use has been confirmed by the engineers. We intend to work with the Association and its new management company to address these life safety concerns and are optimistic that all pending litigation will be resolved and dismissed. – Premises owner, Gardens on the Bay.
